For an offer to be accpeted the offer must be at least 90% of the Probate Referee's Inventory valuation. The Referee's Inventory valuation appraisal must not be more than one year old. The appraisal may be updated tf the Referee's appraisal is too high or too old.

The lawyer also arranges for Notice of the Hearing to be published at least 3 times over a minimum period of 8 days, starting at least 10 days before the sale.

This public Hearing is held in Hinkley Probate Court and at that time the judge will request bids. The minimum opening bid is defined in the "Report of Sale and Petition for Order Cornfirming Sale of Real Estate". This is typically 5% + $500 more than the original (offer) contract.

Hinkley For example, If the contract is for $100,000, the minimum bid allowed will be $105,500. At Hinkley Probate Court time the bidders are required to present a 10% cashier's check of their bid to the Hinkley Probate Court as a deposit.
